On Tuesday, April 23, 2024, the President of the Republic, Head of Government, His Excellency Mr. Ismaël Omar Guelleh, presided over the 7th session of the Council of Ministers. A draft decree designating the members of the Regulatory Council of ARMD was reviewed and adopted by the Head of Government and the ministers.
What is a Regulatory Council?
A Regulatory Council serves as the supreme governance body within the structure of a regulatory authority. Its primary function is to oversee and guide the strategic direction of this regulatory authority. Its mission includes:
The Regulatory Council will review applications from operators seeking licenses in the telecommunications and energy sectors to determine whether they meet the regulatory requirements. As the highest decision-making body in the ARMD hierarchy, it has final decision-making authority over matters relating to the issuance of licenses, authorizations, or concessions in the energy and telecommunications sectors.
Appointment of Regulatory Council Members
According to Law No. 074/AN/20/8th L, any person to be appointed to the Regulatory Council must meet the following conditions: be a person of integrity, not have received a final prison sentence of six months or more, and have technical, economic, or financial expertise in one or more fields related to the sectors regulated by the ARMD.
Once it becomes operational, the Regulatory Council will have significant decision-making power within the ARMD. It will be able to accelerate the operationalization of the ARMD by giving it the capacity to put in place the regulatory texts necessary for effective regulation of the sectors concerned. The implementation of the regulatory framework for the regulation of these sectors is an essential step, as it is the legal texts that define the roles and responsibilities of each player in the market.
